How long can a principal suspend a student?

The Code of Maryland Regulations (COMAR), 13A.08.01.11 C.3.a. authorizes a school principal to suspend a student for up to ten consecutive school days.

 

If I disagree with a principals’ suspension, can I appeal?

The Student Rights and Responsibilities Handbook outlines the appeal structure for suspensions.  Disputes for a short-term suspension (1-3 days) or long-term suspension may addressed with the Pupil Personnel Worker.  

 

What must my child receive if they are suspended?

Every child is entitled to receive instruction when suspension. For extended suspensions and expulsions, if the student is not placed in an alternative educational program the School Liaison will ensure, on a weekly basis, that daily classwork and assignments are provided, graded, recorded and returned to the student.  If assignments are not received or challenges are encountered, please contact the school.

 

What are the possible outcomes from the disciplinary hearing with the Office of Appeals and Hearings?

After hearing the evidence presented at the hearing and reviewing all of the relevants facts, the Office of Appeals and Hearings may uphold the school's request for an extended suspension or expulsion, modify the request or deny the request. There may be a decision that an alternate school placement is best for the student. This information is included in the determination letter.

 

Can changes be made to the Office of Appeals and Hearings determination once it is issued? 

Generally, once the determination is issued, the case is closed and can only be addressed through an appeal to the Board of Education.  The Office of Appeals and Hearings will amend a determination letter for a clerical error.

 

If I disagree with the determination of the Office of Appeals and Hearings, how do I appeal?

A parent has the right to appeal the decision for an extended suspension or expulsion to the Board of Education within ten calendar days of the written letter from the Office of Appeals and Hearings. Written statements of appeal must be sent to the Board of Education, Attn: Board Appeals at Prince George’s County Public Schools, 14201 School Lane, Upper Marlboro, MD 20772 or via email at board.appeals@pgcps.org.
